Brennan and Cavins Win Not Guilty in Medical Malpractice Case Alleging Wrongful Death of a Minor

Brennan Burtker LLC congratulates Partners Mark M. Brennan and Jonathan E. Cavins on securing a successful defense verdict on October 12 for a pediatric hematologist and a leading university medical center in a medical malpractice trial alleging death of a 9-year-old. Plaintiff claimed the pediatric hematologist failed to hospitalize and properly treat a pediatric patient for her platelet disorder over a two-month period. It was claimed that the patient developed worrisome bleeding symptoms at a time when her platelets were at the lowest reportable level or undetectable on weekly blood draws, requiring immediate treatment to prevent a life-threatening bleed.  The patient encountered a catastrophic intracranial hemorrhage, and was hospitalized for six weeks before her unfortunate death. The plaintiff incurred nearly $2.8 million in medical bills, and left surviving her parents and four siblings. Brennan and Cavins argued the care was appropriate and within the standard of care at all times, and that their client did not cause the death of the patient. Brennan and Cavins further argued that the pediatric hematologist was required to treat symptoms, not platelet levels, and that their client appropriately treated the patient’s bleeding symptoms at all times. Brennan and Cavins also argued the patient’s complication was neither foreseeable nor preventable when the bleeding symptoms developed. The plaintiff asked the jury for damages in an amount that totaled over $44.26 million dollars. The verdict in favor of the defense occurred after about 3 ½ hours of deliberation.  This was Brennan’s third consecutive defense verdict in four months, and Cavins’ second consecutive defense verdict in two months.
