Mark M. Brennan, Rachel Stern, and Jonathan Cavins were recognized for obtaining a not guilty verdict after a three week medical malpractice trial before Judge Janet Brosnahan in 2020. The Brennan Burtker team successfully defended the care of one of its hospital clients in a complex medical malpractice case where the defense was presented with unique and extraordinary challenges due to an adverse pre-trial ruling on one of the allegations of negligence against its client. The plaintiff alleged that her husband was under-resuscitated from burn injuries, resulting in a 17-minute cardiac arrest which caused the patient to develop devastating neurologic injuries. The plaintiff claimed her husband’s condition deteriorated in the several hours prior to the arrest, during which time there was no documented presence of a physician and no documented communication between the health care providers alleged to have been negligent. The Brennan Burtker team not only successfully defended all aspects of its client’s care, but also convinced the jury that the care which was the subject of the pre-trial judge’s ruling of negligence did not cause the catastrophic brain injury. The plaintiff requested a verdict in excess of $43 million dollars at trial. The jury deliberated for less than 8 hours before a verdict in favor of the defense was returned on March 13, 2020.
