Brennan Burtker Wins Not Guilty In Orthopedic Malpractice Trial

Brennan Burtker congratulates Mark M. Brennan and Jonathan E. Cavins for their success in obtaining a not guilty verdict in an orthopedic malpractice trial.  The jury verdict was returned in favor of the defense after less than 1 hour of deliberation. 

The plaintiff contended that a shoulder hemiarthroplasty performed by the defendant orthopedic surgeon failed within weeks of the surgery, requiring another surgeon to perform a more complex reverse shoulder replacement surgery one year later. 

Brennan and Cavins successfully argued that the shoulder hemiarthroplasty was performed appropriately, and that the development of scar tissue in the patient, in conjunction with her age and co-morbidities, led to the revision surgery one year later.  This is the second successful defense verdict for Brennan Burtker in 2017.
