The firm congratulates partner Daniel J. Pylman on the successful defense of a defendant landowner sued for breaching a construction contract. Plaintiff, a general contractor, alleged the defendant allowed work to be performed pursuant to a written contract and then breached the contract by failing to pay for the work.
Mr. Pylman put on evidence, including the testimony of a subsequent contractor, which demonstrated the work performed was substandard and defective.
The arbitrator ultimately held the plaintiff failed to prove it had performed under the contract and failed to prove breach by the defendant, resulting in a finding of no liability.
