Masciopinto and Conlon Secure Defense Verdict in Medical Malpractice Case Alleging Negligence Resulting in Hysterectomy

Brennan Burtker LLC congratulates Partners Vito Masciopinto and Tom Conlon on securing a successful defense verdict on March 31, 2026, for a university-based radiologist. The care and treatment in the case occurred 11 years prior, in 2015. A female patient presented for induction of labor but required a cesarean section complicated by blood loss. Post-operatively, the patient developed an ileus, and a CT scan was ordered to rule out a small bowel obstruction. The defendant radiologist confirmed the presence of an ileus and ruled out a small bowel obstruction, while noting other post-partum findings. After a 10-day admission, the patient was discharged home. Three days later, the patient was diagnosed with an abdominal abscess at an outside hospital. The Plaintiff alleged the radiologist failed to appropriately interpret the CT scan completed during the admission at issue by failing to diagnose an abscess and/or infection resulting in hysterectomy. The Plaintiff asked for $7.3 million from a Cook County Jury for damages. The defense demonstrated that what the Plaintiff’s radiology expert identified as an abscess was actually the small bowel. The defense established that the radiologist appropriately interpreted the CT scans, and that there were no signs of infection or abscess. The case was tried over 2.5 weeks before Judge Bridget Hughes.
