Three-week Trial for Longo and Polit Yields Defense Verdict in Forty Minutes

Brennan Burtker LLC congratulates partners Anthony Longo and Elizabeth Polit for securing a quick not guilty verdict after a long bifurcated medical malpractice trial. Plaintiff, in her capacity as Independent Administrator of the Estate of her deceased mother, initiated this case in the Circuit Court of Cook County seeking significant damages for herself and five additional next of kin. The suit alleged that the defendants were negligent for failing to monitor and document the patient’s inpatient dialysis care during an admission to a local hospital, and that the alleged negligence resulted in dialysis induced cardiac arrest and anoxic brain injury. Plaintiff argued that hemodialysis was contraindicated for the patient, but nevertheless occurred on the date in question. Longo and Polit argued that dialysis did not occur, and that the inpatient dialysis institution they represented complied with the standard of care. After 40 minutes of deliberation, the jury returned a verdict in favor of the defense.
