Brennan Burtker LLC Wins Summary Judgment In Pediatric Spine Case on Proximate Cause

Brennan Burtker is pleased to announce a victory on behalf of its clients in a pediatric spine case involving a paralyzed patient.  Mark M. Brennan represented a leading children’s hospital and its pediatric orthopedic surgeon in a complex medical malpractice case alleging the failure to properly treat a kyphotic spine in a 14 year old young woman.

The plaintiff became paraplegic. During the course of expert discovery, plaintiff’s pediatric orthopedic expert made concessions under cross-examination on causation as to the level of injury at the spine, which Brennan used as a basis for a Motion for Summary Judgment prior to trial.  The trial court granted the motion, which recently became a final judgment.
