Brennan Burtker LLC congratulates Partners Robert Burtker and Rachel Stern on securing a successful defense verdict on August 6 where they represented an interventional radiologist. Plaintiff claimed that our client’s negligence led to a below the knee amputation of her leg. It was also contended that the interventional radiologist should have restrained and sedated her during the course of a 3-day tPA infusion to treat a popliteal artery occlusion so that she would not bend her leg, which Plaintiff claimed lessened the effectiveness of the therapy. The defense argued that restraining a patient is not part of tPA treatment and further argued that the Plaintiff’s inability to keep her leg straight had no effect on the tPA. Unfortunately, the Plaintiff lost her leg because during the course of treatment, she developed distal embolization of the clot to her foot, which is a recognized risk of the treatment. Plaintiff asked the jury to award in excess of $7 million.
