Brennan Burtker Obtains Not Guilty Verdict in a Three Week Complex Medical Malpractice Trial

Brennan Burtker congratulates Mark BrennanRachel Stern, and Jonathan Cavins for their amazing not guilty verdict after a three week medical malpractice trial before Judge Janet Brosnahan. Brennan Burtker also thanks its newest Associate, William Garvey, for his invaluable assistance to the trial team in the preparation and defense of this case for trial. 

The Brennan Burtker team successfully defended the care of one of its hospital clients in a complex medical malpractice case where there was a pre-trial finding of negligence on an allegation against its client.

The plaintiff alleged that her husband was under-resuscitated from burn injuries, resulting in a 17-minute cardiac arrest which had caused the patient devastating neurologic injuries. The Brennan Burtker team not only successfully defended all aspects of its client’s care, but also convinced the jury that the care which the pre-trial judge had deemed negligent did not cause the catastrophic brain injury. The plaintiff requested a verdict in excess of $43 million dollars at trial. The verdict in favor of the defense was returned within 24 hours.
